União deve recuperar R$ 200 mi de tributo

BRASÍLIA – A Procuradoria Federal (PF) junto ao Departamento Nacional de Produção Mineral (DNPM) informou ontem que conseguiu confirmar no Supremo Tribunal Federal (STF) decisão do Superior Tribunal de Justiça (STJ) para que as empresas mineradoras não descontem da base de cálculo da Compensação Financeira pela Exploração de Recursos Minerais (CFEM) o transporte e o seguro do produto, enquanto o mineral ainda estiver em estado bruto.”O STF acatou a interpretação da Procuradoria”, informa o comunicado. Segundo o procurador Ricardo Mourão Pereira, a decisão é importante para o patrimônio público, pois traz um acréscimo aproximado de 10%, no preço pago mensalmente pelas empresas exploradoras de minério de ferro e metais básicos. “Isso evitará uma redução na base de cálculo da CFEM, ajudando na recuperação de créditos em torno de R$ 200 milhões”, informa o procurador Pereira.Segundo o comunicado, a Procuradoria Federal sustentou que as despesas de transporte e seguro somente poderiam ser deduzidas sobre a venda do produto mineral – substância pronta para ser comercializada.Ainda de acordo com o comunicado, o Sindicato Nacional da Indústria da Extração de Ferro e Metais Básicos (Sinferbase), que representa as empresas mineradoras, defendeu a tese de que essas despesas poderiam ser recebidas pelo empresário desde a extração até o momento da venda do produto.
