Desestimulando investimentos

No momento em que se busca implementar reformas estruturais que criem condições para o crescimento econômico, foram editadas medidas provisórias que alteram royalties e normas sobre a exploração mineral e criam a Agência Nacional de Mineração (ANM). A MP 789 mudou a base de incidência dos royalties (CFEM), de receita líquida para receita bruta, o que implica tributar também transporte, seguros e serviços portuários. No Brasil, o subsolo é de propriedade da União, sendo os royalties a forma de cobrar às mineradoras por sua utilização. Porém, na prática, instituiu-se sutilmente um novo imposto, incidente sobre a movimentação dos minerais. Na ânsia de aumentar receitas tributaram-se também as pelotas de ferro, resultantes de processo que envolve a transformação industrial do minério de ferro, por isso, considerado produto industrializado na lista do Mercosul, o que gera insegurança jurídica.
O minério de ferro é, de acordo com o Banco Mundial, o produto brasileiro com maior vantagem comparativa no mercado global, e um dos maiores itens da pauta de exportações, com venda externa média anual de US$ 25 bilhões nesta década. A logística é extremamente importante para sua competitividade, pois envolve a movimentação anual de quase 400 milhões de toneladas, o que exige infraestrutura mina-ferrovia-porto integrada e eficiente. Por sua vez, a construção e manutenção dessa base requerem investimentos de bilhões de dólares. Nossas minas distam cerca de 900 km dos portos, ao passo que as da Austrália, nosso principal concorrente, estão a 400 km da costa. Ao estender a base de incidência da CFEM para o transporte ferroviário, o governo brasileiro enfraquece claramente a competitividade de nosso minério de ferro. Como os depósitos de recursos minerais no Brasil são localizados em áreas longe dos portos, a medida afeta desfavoravelmente todos os minerais exportados, como nióbio, ouro, cobre e manganês. A significativa elevação de royalties possui impacto negativo sobre a vida útil das minas, pois desencoraja a realização de investimentos em seu prolongamento ao diminuir o retorno esperado. Conduzirá, então, ao fechamento prematuro de operações e ceifará empregos na mineração, em seus fornecedores e comunidades próximas. A cobrança de royalties sobre a receita, seja bruta ou líquida, é regressiva, elevando os riscos para o empreendedor num negócio já arriscado, e desestimula investimentos em novos projetos ao penalizar a taxa de retorno esperada, distorção magnificada pela MP 789.
Projetos que estão iniciando produção – na fase de “ramp up”, que pode durar até dois ou três anos – operam abaixo da capacidade nominal, o que implica escala insuficiente para diluir custos fixos. Os custos variáveis tendem a ser mais elevados, porque é um estágio de ajustes operacionais, intensivo em “learning-by-doing”. Assim, durante o “ramp up” a lucratividade de um projeto de mineração é muito baixa ou negativa. Se a receita é tributada, em particular a receita bruta, existe razoável probabilidade de taxação de prejuízos, risco adicional para o investidor. Como os fluxos de caixa iniciais têm influência predominante na determinação da taxa de retorno de um investimento, royalties sobre a receita bruta comprimem o retorno esperado de novos projetos, tornando menos atrativo investir em mineração no Brasil. Para a manutenção da ANM, a MP 791 criou um novo imposto, a Taxa de Fiscalização da Atividade Mineral (TFAM), que se soma à CFEM e às taxas de fiscalização da atividade mineral (TFRM) cobradas por alguns Estados na geração de distorções. Num ambiente em que os investimentos globais em mineração caíram 60% nos últimos cinco anos, é paradoxal que alguém afirme que a mineração no Brasil vai crescer se as taxas de retorno são diminuídas e os riscos se elevam. Retornos menores e riscos maiores afugentam o investimento. Abandonou-se a oportunidade de adotar modelo de cobrança de royalties mais eficiente e coerente com a Constituição de 1988.
Em países que gerenciam recursos naturais para a criação de prosperidade, como Austrália, Canadá e Chile, a base de incidência dos royalties é o resultado da exploração, exatamente como prevê a Constituição brasileira. A tributação sobre o lucro não é regressiva e possui impactos menores sobre os investimentos. Existe a visão equivocada de que os royalties sobre a mineração são baixos. A CFEM é apenas um em meio à multiplicidade de impostos incidentes sobre as companhias brasileiras. Segundo estimativas de especialistas, a carga tributária sobre a mineração no Brasil – tanto sobre o faturamento quanto o lucro – é elevada e superior em 30% à média de cinco países onde essa atividade é importante, África do Sul, Austrália, Canadá, Chile e Peru. Enquanto a Austrália está reduzindo a alíquota do IRPJ de 30% para 25%, aumentamos consideravelmente os royalties, o que ampliará o fosso existente.
O governo optou por trocar o desestímulo a investimentos privados por mais receita para os municípios, beneficiários de 65% da arrecadação dos royalties e cujas finanças encontram-se seriamente debilitadas, o que se deve em grande parte a seus prefeitos. Entre 2003 e 2013 – anos de crescimento econômico – o número de servidores municipais se expandiu em 66% e os salários reais em 59%, sem contrapartida da melhoria de serviços públicos. Uma ação típica da Velha Política, cujas medidas anunciadas tentam adiar a morte. A literatura econômica sobre ajustes fiscais evidencia que o caminho mais eficiente e eficaz para reequilibrar as finanças públicas é o corte de gastos. Aumentos de tributos têm efeito apenas temporário sobre os déficits e causam distorções que restringem o crescimento econômico. Num mercado global extremamente competitivo não é possível exportar impostos. Asiáticos e europeus não pagarão pelos erros da política econômica brasileira. Já as mineradoras australianas agradecem a cortesia de nosso governo.
